Sedition: Why This Law Is Not Enforced

What is Sedition? The Webster's Ninth New Collegiate Dictionary says; incitement of resistance to or insurrection against lawful authority. Seditious; disposed to arouse or take part in or guilty of sedition.

The Sedition Act of 1918 is as follows: (partial)
SECTION 3. Whoever, when the United States is at war, shall willfully make or convey false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States, or to promote the success of its enemies, or shall willfully make or convey false reports, or false statements,...or incite insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or shall willfully obstruct...the recruiting or enlistment service of the United States, or...shall willfully utter, print, write, or publish any disloyal, profane, scurrilous, or abusive language about the form of government of the United States, or the Constitution of the United States, or the military or naval forces of the United States...or shall willfully display the flag of any foreign enemy, or shall willfully...urge, incite, or advocate any curtailment of production...or advocate, teach, defend, or suggest the doing of any of the acts or things in this section enumerated and whoever shall by word or act support or favor the cause of any country with which the United States is at war or by word or act oppose the cause of the United States therein, shall be punished by a fine of not more than $10,000 or imprisonment for not more than twenty years, or both...[...]
Unfortunately, it was repealed in 1921. This is why the Sedition Act is not enforced. But, let not your hearts be troubled. Just because the Sedition Act was repealed in 1921, doesn't get the cowards in DC a Get Out Of Jail Free Card. {side bar...good read here} (Smith Act)

CHAPTER 115 - TREASON, SEDITION, AND SUBVERSIVE ACTIVITIES

Section 2382. Misprision of treason [NOTE: all bold and/or emphasis is mine]

Whoever, owing allegiance to the United States and having knowledge of the commission of any treason against them, conceals and does not, as soon as may be, disclose and make known the same to the President or to some judge of the United States, or to the governor or to some judge or justice of a particular State, is guilty of misprision of treason and shall be fined under this title or imprisoned not more than seven years, or both.

Section 2388. Activities affecting armed forces during war

(a) Whoever, when the United States is at war, willfully makes or conveys false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States or to promote the success of its enemies; or Whoever, when the United States is at war, willfully causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or willfully obstructs the recruiting or enlistment service of the United States, to the injury of the service or the United States, or attempts to do so - Shall be fined under this title or imprisoned not more than twenty years, or both.

(b) If two or more persons conspire to violate subsection (a) of this section and one or more such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be punished as provided in said subsection (a).

(c) Whoever harbors or conceals any person who he knows, or has reasonable grounds to believe or suspect, has committed, or is about to commit, an offense under this section, shall be fined under this title or imprisoned not more than ten years, or both.

(d) This section shall apply within the admiralty and maritime jurisdiction of the United States, and on the high seas, as well as within the United States.


So, even though the Sedition Act was repealed, there are still laws on the books with much the same language.

An amendment to 18 U.S.C. § 2385 which, taking specific cognizance of the current threat from Islam, establishes that the preaching of Jihad is tantamount to knowing and willful advocacy of "overthrowing or destroying the government of the United States"; that whoever, in accordance with the doctrine of Jihad, "prints, publishes, edits, issues, circulates, sells, distributes, or publicly displays any written or printed matter advocating, advising, or teaching the duty, necessity, desirability, or propriety of overthrowing or destroying any government in the United States" shall be "fined under this title or imprisoned not more than twenty years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction."

Before I made the move to A Newt One, I had written 43 pieces on Sedition and know the subject well.

These fools here are a prime example of violations of the laws currently on the books in regards to seditious activities, especially in a time of war, regardless if the war is considered but not legally defined as "illegal". Ignorance of the law is no excuse, as it were.

The law is not enforced because the cancer Political Correctness and the redefined definition of Freedom of Speech has morphed into an approval of organized Anarchy (oxymoron) and there are no Spines of Steel residing in DC anymore...Mr, Mrs, Ms, and Miss Milquetoasts all. I suppose they will finally step in when True Patriots have had enough of this and there is blood in the streets when this kind of treachery could have been nipped in the bud from the get go. But, there are political aspirations and political careers to protect.
