Synod of Sin: Mideast Catholics Sell Out At the end of the Middle East Synod, a statement was issued. I found it at Asia News.  As I expected, it reflects dhimmitude & lunacy.  I have excerpted what I perceive as the worst of it, added emphasis to it and will respond critically.  Use the link above to read the entire statement in context. We have taken account of the impact of the Israeli-Palestinian¹ conflict² on the whole region, especially on the Palestinians¹ who are suffering the consequences of the Israeli occupation³: the lack of freedom of movement, the wall of separation and the military checkpoints⁴, the political prisoners⁵, the demolition of homes⁴, the disturbance of socio-economic life⁶ and the thousands of refugees⁷. We have reflected on the suffering and insecurity in which Israelis live⁸. We have meditated on the situation of the holy city of Jerusalem. We are anxious about the unilateral initiatives⁹ that threaten its composition and risk to change its demographic balance¹⁰. With all this in mind, we see that a just and lasting peace¹¹ is the only salvation for everyone and for the good of the region and its peoples.

Recourse to theological and biblical positions which use the Word of God to wrongly justify injustices¹² is not acceptable. On the contrary, recourse to religion must lead every person to see the face of God in others and to treat them according to their God-given prerogatives and God’s commandments, namely, according to God's bountiful goodness, mercy, justice and love for us.

We are united by the faith in one God¹³ and by the commandment that says: do good and avoid evil. The words of the Second Vatican Council on the relations with other religions offer the basis for the relationship between the Catholic Church and the Muslims: “The Church regards with esteem also the Muslims. They adore the one God¹³, living and subsisting in Himself; merciful and all- powerful, the Creator of heaven and earth, who has spoken to men” (Nostra aetate 3).

We say to our Muslim fellow-citizens: we are brothers and sisters; God wishes us to be together, united by one faith¹⁴ in God and by the dual commandment of love of God and neighbour. Together we will construct our civil societies on the basis of citizenship, religious freedom and freedom of conscience. Together we will work for the promotion of justice¹⁵, peace¹⁶, the rights of persons and the values of life¹⁷ and of the family. The construction of our countries is our common responsibility. We wish to offer to the East and to the West a model of coexistence¹⁸ between different religions and of positive collaboration between different civilisations for the good of our countries and that of all humanity.

We address you regarding the importance of equality¹⁹ among all citizens. Christians are original and authentic citizens who are loyal to their fatherland and assume their duties towards their country. It is natural that they should enjoy all the rights of citizenship, freedom of conscience, freedom of worship and freedom in education, teaching and the use of the mass media.

We appeal to you to redouble your efforts to establish a just and lasting peace²⁰ throughout the region and to stop the arms race, which will lead to security and economic prosperity and stop the hemorrhage of emigration which empties our countries of its vital forces. Peace is a precious gift entrusted by God to human family, whose members are to be “peacemakers who will be called children of God” (Mt 5:9).

The citizens of the countries of the Middle East call upon the international community, particularly the United Nations conscientiously to work to find a peaceful, just and definitive solution²¹ in the region, through the application of the Security Council’s resolutions²² and taking the necessary legal steps to put an end to the occupation of the different Arab territories²³.

The Palestinian¹ people will thus have an independent and sovereign homeland where they can live with dignity and security²⁴. The State of Israel will be able to enjoy peace and security within their internationally recognized borders. The Holy City of Jerusalem will be able to acquire its proper status, which respects its particular character, its holiness and the religious patrimony²⁵ of the three religions: Jewish, Christian and Muslim. We hope that the two-State-solution²⁶ might become a reality and not a dream only.

We condemn violence and terrorism from wherever it may proceed²⁷ as well as all religious extremism. We condemn all forms of racism, anti-Semitism, anti-Christianism and Islamophobia²⁸ and we call upon the religions to assume their responsibility to promote dialogue between cultures and civilisations in our region and in the entire world.

2. The conflict between Islam and disbelievers is global, not local. Wheresoever Islamic terror & genocide are dispersed over the face of the earth, the conflict is one, dictated by Surah Al-Anfal & Surah At-Taubah. Allah's immutable & timeless book commands Muslims to wage war upon pagans, Jews, Christians & Zoroastrians until only Allah is worshiped, all resistance ceases and the "people of the book" are subjugated and submit to continuing extortion. 
3. Israel is occupied, not occupying. The land belongs to Jews, not to Muslims.  Read the history at Palestine Facts.
4. If Muslims were not waging war against Jews, there would be no security measures to complain about. The Jewish state is obligated to protect her citizens. She could obliterate her attackers or erect barriers to keep them out. Which is more humane?
5. What political prisoners? Is Israel holding anyone who was not directly involved in, aware of or planning & facilitating terror attacks?  Would you be happier if Israel simply killed them instead of arresting and imprisoning them?
6. Everything you complain about would come to an end if the genocidal attacks would end. Falestinians do not want prosperity, they want genocidal conquest.
7. There would be no refugees if the Muslims had not attacked Israel in 1948. Nasser told them to leave and clear the way for pushing the Jews into the sea. Israel does not deserve blame for that.
8. All of your emphasis is on the self-imposed suffering of Israel's enemy. The whole affair is a function of Islam's determination to destroy Israel and exterminate the Jews. Why can't you acknowledge that fact and face reality?
9. Who built the city and made it their nation's capital? For what good reason should Jews be denied the right to construct housing and live in their capital city?  In 1948, Jordan illegally seized half the city and excluded Jews from it. They desecrated cemeteries & synagogues. Was that unilateral? Why do you ignore it?
10. Jerusalem is a Jewish city; it is the capital of Israel. Why should it be half full of Muslims?  Why should Jews be excluded from any part of their capital city?
11. The conflict is existential. Peace is only possible if one side or the other is exterminated. If the aggressors exterminate the defenders, is that justice?  The conflict flows from the Jews of the Hijaz recognizing Moe's fraud and scorning him. He designed Islam to appeal to Jews. They knew what he had done and rejected Islam. His first conquests were against those Jews. He said something which should hold your attention.
    
      He said to them, "If you embrace Islam, you will be safe.You should know that the earth belongs to Allah and His Apostle, and I want to expel you from this land. So, if anyone amongst you owns some property, he is permitted to sell it, otherwise you should know that the Earth belongs to Allah and His Apostle."  [Sahih Bukhari 4.53.392]
    
    He said something else, which indicates to the intelligent, open minded reader, that his intent is genocidal. They will not stop until they kill the last Jew, because admission to Paradise is dependent on that act.
    
    "The Hour will not be established until you fight with the Jews, and the stone behind which a Jew will be hiding will say. "O Muslim! There is a Jew hiding behind me, so kill him." [Sahih Bukhari 4.52.177]
    
    The identity of the aggressor becomes clear after reading another hadith in which Moe expresses his intent.
    
    The Prophet (peace_be_upon_him) said: It will turn out that you will be armed troops, one is Syria, one in the Yemen and one in Iraq. Ibn Hawalah said: Choose for me, Apostle of Allah, if I reach that time. He replied: Go to Syria, for it is Allah's chosen land, to which his best servants will be gathered but if you are unwilling, go to your Yemen, and draw water from your tanks, for Allah has on my account taken special charge of Syria and its people. [Sunan Abu Dawud 14.2477]
12. Is there a way to rightly justify injustices?  Where is the justice in driving Jews out of their homeland? Where is the justice in demanding that Judea & Samaria be Judenrein; exclusively for Muslim Arabs?? Where is the justice in rewarding the aggressors with land?  What precedent does that set for other "conflicts"?
13. There is one God, and Allah ain't him. If you think that Allah & Jehovah are one and the same, you have a new thought coming. Compare:

    Self-sacrifical love and arbitrary predestination do not describe the same entity unless that entity is severely schizophrenic.
14. You should be "united by one faith" with the Muslims? So convert to Islam if  you really believe that.  Conversion is a one way street in Arabia, so conversion to Islam is your only path to unity. 
15. To Islam, justice means "just us". 
16. To Islam, peace means what they enjoy when their global conquest is completed successfully.  
17. Muslims do not value life, they value conquest. Achieving Shahid status is their only guaranteed Get Out of Hell Free Card.
    
    9:38. O you who believe! What is the matter with you, that when you are asked to march forth in the Cause of Allâh (i.e. Jihâd) you cling heavily to the earth? Are you pleased with the life of this world rather than the Hereafter? But little is the enjoyment of the life of this world as compared with the Hereafter.
    13:26. Allâh increases the provision for whom He wills, and straitens (it for whom He wills), and they rejoice in the life of the world, whereas the life of this world as compared with the Hereafter is but a brief passing enjoyment.
    61:10. O You who believe! Shall I guide you to a commerce that will save you from a painful torment.

    61:11.  That you believe in Allâh and His Messenger (Muhammad ), and that you strive hard and fight in the Cause of Allâh with your wealth and your lives, that will be better for you, if you but know!

18. There is no coexistence with Islam. Islam conquers.
    
    The Messenger of Allah stated that no two religions should remain in the Arabian Peninsula, and the Jews and Christians should be expelled from it, all praise is due to Allah. [The Good News that Islam shall prevail]
19. Under Islamic law, you ain't equal, you are inferior.
    
    1. You can not hold public processions, prayers, or funerals.
    2. You can not build or maintain churches. 
    3. You can not testify in court. 
    4. Your life is worth only one third as much as a Muslim's. 
20. Peace is the absence of Islam.  While there is Islam, peace is impossible.  This is be cause Islam is permanent war. 8:39 & 9:29 command it. Sahih Bukhari 1.8.387 confirms it. Reliance of the Traveller o9.8 & 9.9 codify it.  "jihad will be performed continuously since the day Allah sent me as a prophet until the day the last member of my community will fight with the Dajjal "[Sunun Abu Dawud 14.2526]
21. A solution can not be real or peaceful unless it removes Islam from a radius = rocket range around Jerusalem.  It can not be just unless it leaves Israel in full sovereignty over  Eretz Yisrael. 
22. Those resolutions are unjust, biased and without foundation in morality. They are not a foundation for peace.
23. Eretz Yisrael is not Arab territory. President Obama is ending our occupation of Iraq. We'll let the Sunni & Shi'ia kill each other. 
24. They have no homeland; their homelands are Egypt, Jordan, and other places from which they migrated to Israel. They can have no dignity while enslaved to Allah. To obtain dignity, they must abandon Islam  and join the human race. As Muslims, they are the threat to security.
25. Islam's stake in Jerusalem is strictly proscriptive: a game of keep away. Their only claim to the city resides in Moe's nightmare.
26. Two states: Israel & Jordan. There is no need for a third: Fallestine, since it is a fallacy; pure malicious malarkey.

28. If you condemn antisemitism & Christianophobia, then you must condemn Islam, because the Qur'an is full of them. By condemning criticism of Islam and revelation of its true nature, you demonstrate your own moral corruption. So, you want to dialogue with Islam? Then open a conversation about Christ's paternity, deity, crucifixion, resurrection & what he will do when he returns. According to Moe, when Jesus comes back, he is going to lead the Muslims in the final battle to exterminate you and the Jews.  That is a great starting point for your cherished dialogue.

This video was shot on the 23rd, the intervening days were used in creating the sub titles.  The tape was made  on the occasion of a court hearing. Hector was speaking softly because the taping was clandestine.  I expect that when the Paki's find out about it, he will pay in pain.

    There is no justice for Christians in Islam dominated areas. I do not know the extent to which Pakistani law mirrors Shari'ah, I only know that this is the standard set by Umdat al-Salik.

Obamination: Iftar Treason

President Obama celebrated sunset with an Iftar Tuesday, August 1, 2009. Excerpts from his remarks follow, with my comments interspersed.

Islam, as we know, is part of America.

Islam can not be a part of America. Islam is, by its own intrinsic nature, permanently alienated. In the Islamic world view, only Allah has the right to rule. Any government that rules by man made law instead of Shari'ah is unjust and must be removed by Jihad, if necessary. Moe prophesied that Jesus Christ will rule by the Qur'an when he returns.

Islam is not compatible with democracy. Allah said "It is not for a believer, man or woman, when Allâh and His Messenger have decreed a matter that they should have any option in their decision." [33:36] Allah and his Messenger (or Caliph ) make all the decisions; Joe Camel has no choice in the matter. Islam is theocratic autocracy, the polar opposite of democracy.

One of those values is the freedom to practice your religion -- a right that is enshrined in the First Amendment of the Constitution. Nashala Hearn, who joins us from Muskogee, Oklahoma, took a stand for that right at an early age. When her school district told her that she couldn't wear the hijab, she protested that it was a part of her religion. The Department of Justice stood behind her, and she won her right to practice her faith.

The practice of Islam entails more than hijab, salat, zakat, hajj & iman. Islam is not complete without Jihad, which is mandatory, not an optional extra. Jihad is defined in Islamic law as making war on non-Muslims. [Reliance of the Traveller, O9.0.] Jihad is a communal obligation, binding upon Muslims in every year. [O9.1]

The annual obligation to perform Jihad is confirmed by fiqh. Observe what Al-Shafi-i said about it. "The least that the imam must do is that he allow no year to pass without having organised a military expedition by himself, or by his raiding parties, according to the Muslims' interest, so that the jihad will only be stopped in a year for a (reasonable) excuse."

If Muslims have a right to practice their religion, then they have a right to kill you, rape your widow, enslave your orphans and seize your property. If there is a right to practice Islam, we have no rights.

They all contain truths. Among those truths are the pursuit of peace and the dignity of all human beings. That must always form the basis upon which we find common ground.

Islam divides the world into Dar al-Islam, where Allah's writ runs and Dar al-Harb, where Allah's writ does not run. Peace is when Dar al-Harb (the house of war) is conquered and engulfed by Dar al-Islam. I suggest that you read O9.8 & O9.9 of Reliance of the Traveller. So much for the pursuit of peace.

Islam recognizes the dignity of Muslims, not all human beings. Pagans & Atheists are to be converted, enslaved or killed, people with scriptural religions are to be subjugated and extorted, surviving as sub-humans living at sufferance. One of Islam's codified oral traditions has Moe declaring that our blood and property are not sacred to Muslims until we become Muslims. [Sahih Bukhari 1.8.387.]

Together, we have a responsibility to foster engagement grounded in mutual interest and mutual respect.

There is no mutual interest between prey and predator. Respect is earned, Islam has not earned it. Respect is reciprocal, Islam gives none, see the citation immediately above: our blood and property are not sacred to Muslims.

So tonight, we celebrate a great religion, and its commitment to justice and progress.

What is Islam's greatness? Judaism gave us monotheism. Christianity gave us hope of salvation. Islam gives us predestination & predation. Islam's 'greatness', which it seeks to restore, is the Caliphate which enslaved nearly half the world at its peak.

What commitment to justice and progress? Shari'ah prescribes hudud, including corporal punishment. Proving rape requires four male witnesses who observed penetration. Rape victims are punished. The testimony of two women is required to equal that of one man.

Ten days prior to the eighth anniversary of the Accursed Abomination, our recently elected President celebrated the month in which the damnable book was "revealed"; the book whose sanctification of Jihad motivated the nineteen murderers of three thousand of our fellows. He referred to the war cult which sponsored the attack a "great religion", praising its "commitment to peace" & justice.

Allahu skata!! Camel dung in the desert. Islam: predatory war cult. Moe: profiteering pirate, pretender to prophecy, pederast, lecher & murderer. Obama: traitor. You fools who elected him should burn your voter registration cards and hang your heads in shame. No words can express my disgust.

Obamination: Ramadan Treason

President Obama's Ramadan message includes the usual boiler plate treason. I have selected some exemplary dissembling for refutation.

• "These rituals remind us of the principles that we hold in common"

The implication is both overly broad and false. Islam does not share any principles with Western Civilization. Next time, list them and submit proof that Muslims share them. I won't hold my breath while I wait for that list and evidence.

• lslam's role in advancing justice, progress,. tolerance, and the dignity of all human beings

Nothing could be further from the truth. Reliance of the Traveller, Book O, Chapter 9, Paragraphs 8 &9 charge the Caliph with the duty of attacking Jews, Christians, Zoroastrians & Pagans at least once in every year. Those laws are based on Surahs At-Taubah & Al-Anfal of the Qur'an. Exactly how does that advance justice, tolerance & dignity?

Chapter 11, Paragraph 5, says of dhimmis:

• 2- are distinguished from Muslims in dress, wearing a wide cloth belt (zunnar);

• 3- are not greeted with "as-Salamu 'alaykum";

• -4- must keep to the side of the street;

• -5- may not build higher than or as high as the Muslims' buildings, though if they acquire a tall house, it is not razed;

• -6- are forbidden to openly display wine or pork, (A: to ring church bells or display crosses,) recite the Torah or Evangel aloud, or make public display of their funerals and feastdays;

• -7- and are forbidden to build new churches.

Exactly how do those laws advance justice, tolerance & dignity?

• "For instance, fasting is a concept shared by many faiths - including my own Christian faith - as a
  way to bring; people closer to God, and to those among us who cannot take their next meal for
  granted. And the support that Muslims provide to others recalls our responsibility to advance
  opportunity and prosperity for people everywhere. For all of us must remember that the world we
  want to build - and the changes that we Want to make - must begin in our own hearts, and our
  own communities."

Note the clause which I emphasized: Islamic law forbids giving Zakat to Kufar. Refer to Reliance of the Traveller H8.24.

• It is not permissible to give zakat to a non-Muslim, or to someone whom one is obliged to support (def: m12.1), such as a wife or family member.

President Obama conflates charity & universal benevolence with Socialism and at the same time, mixing domestic policy with foreign.

• "Beyond America' borders. we are also committed to keeping our responsibility to build a world
  that is more peaceful and secure. That is why we are responsibly ending the war in Iraq."

The invasion of Iraq could only increase peace & security by rendering Iraq unIslamic. Iraq & Afghanistan will be threats to peace & security so long as their people and governments are Islamic. By leaving Iraq with Islam still in place, we decrease peace and security below the level pertaining before the invasion.

• 'That is why we are isolating violent extremists while empowering the people in places like Afghanistan
  and Pakistan."

"Violent extremists" is a shibboleth designed to draw our attention away from the fatal fact of intrinsic violence in Islam.. Islamic Jihad, terrorism & genocide result from intrinsic scriptural doctrines & traditional example, not from 'extremists'. The difference between 'extremists' and 'the people' is zeal. Violence is a function of intensity of belief & zealotry. We can't isolate them because we can't identify them. Besides, zealotry can increase spontaneously or as a result of aggressive sermons at the local Mosque.

• "That is why we are unyielding in our support for a two-state solution that
  recognizes the rights of Israelis and Palestinians to live in peace and security."

Israelis are Palestinians. Palestinians are Jews . The so called Palestinians President Obama refers to are undifferentiated Arabs seeking to reconquer Israel demographically and militarily. State or no state, so long as there are Muslims within rocket range of Israel, Israel will not obtain peace or security no matter what she does. Israel's existence is an offense to Muslims because her land was conquered by Caliph Umar in 638. Allah promised Muslims victory and dominance over the region. By reclaiming her land, Israel proves Allah to be an impotent idol. Muslims can't tolerate that! Muslims will continue to attack Israel until they are successfully in reconquest or Israel ushers them into hell. There is nothing we can do about it.

• " And that is why America will always stand for the universal rights of all people to speak their mind, practice their
  religion, contribute fully to society and have confidence in the rule of law."

I emphasized the problematic phrase in that sentence. Islam requires Jihad, genocide & terrorism. It is not possible to fully practice Islam without engaging in them until their world conquest is completed. If they have a right to practice Islam, then we have no right to live; no human dignity.

• All of these efforts are a part of America' commitment to engage Muslims and Muslim-majority
  nations on the basis of mutual interest and mutual respect.

Idiocy & treason are in the emphasized phrase. Islam has no respect for Kufar. To Muslims, we are rebels against Allah, and they are duty bound to defeat us and gather us together into Hell, the worst of living creatures. We have no mutual interest with Muslims! Their interest is world conquest, ours is peace, security and prosperity. We have nothing in common.

• "And at this time of renewal, I want to reiterate my commitment to a new beginning between America and Muslims around the world,"

How about a new beginning between lambs and lions? When will lions quit eating lambs? That is when Islam will quit Jihad. Two classes of people say otherwise: damned fools and traitors. Islam is a predatory institution; we need to call it what it is. We need to call those who deny that fatal fact what they are. Intellectual honesty and moral clarity require us to do that.

• From around the world, we have received an outpouring of feedback about how America can be a partner on behalf of peoples' aspirations.

Islam is about enrichment and empowerment through the profession of piracy. Islam seeks total world domination by conquest. That is their only aspiration. Any occidental who seeks to facilitate Islamic world conquest is a traitor! Why Jihad? Because that is how Moe derived his income! Read 8:1, 8:41 & 8:67 and get a clue. The fatal fact of mercenary motivation is confirmed by hadith: When Allah made the Prophet wealthy through conquests, while I was sleeping, the keys of the treasures of the world were brought to me and put in my hand .

So long as our relationship is defined by our differences, we will empower those who sow hatred rather than peace, those who promote conflict rather than the cooperation that can help all of our people achieve justice and prosperity. And this cycle of suspicion and discord must end.

It is a predator:prey relationship. Islam is the predator.

The Qur'an inculcates hatred, it is preached in every Mosque and memorized in every Madrassa. Allah describes us as those who "went astray" and "earned his wrath". Allah describes us as "The worst of (moving) living creatures". Allah demonizes us: "Verily, there are many of the (Jewish) rabbis and the (Christian) monks who devour the wealth of mankind in falsehood, and hinder (them) from the Way of Allâh (i.e. Allâh's Religion of Islâmic Monotheism). And those who hoard up gold and silver [Al-Kanz: the money, the Zakât of which has not been paid], and spend it not in the Way of Allâh, -announce unto them a painful torment." Moe curses us: "Allâh's Curse be on them, how they are deluded away from the truth!"

To Islam, peace is the condition after they conquer the entire world. Dar ul-Islam is where Alllah's writ runs; Dar ul-Harb is where it does not.

Read Reliance of the Traveller, Book O to see how justice is achieved in Islam. Justice means Allah's writ ruling the entire world.

prosperity

In Islam, prosperity follows conquest: the spoils of war and annual Jizya flowing from conquered people. Moe was made wealthy by conquests. The real prosperity is promised for the time when the Mahdi comes and conquers the entire world see Sahih Muslim 41.6964.

Border Agents Were Charged With 'Non-Existent Crime'

They are JUST NOW figuring this out? Haven't WE been saying this EXACT thing since the news broke way back when? Judas Priest! Some people's kids! Read the Cybercast blurb and then, at the bottom, there is a short reference to Judicial Watch's "findings".

Two Border Patrol agents whose prosecution and sentences to lengthy prison terms triggered a political storm this year may have been charged with a "non-existent crime," according to a legal brief submitted to a federal appeals court in May, and obtained by Cybercast News Service.

Ignacio Ramos and Jose Compean are serving 11- and 12-year sentences respectively for shooting and wounding a Mexican national who was trying to escape after attempting to smuggle 743 pounds of marijuana across the Mexico-Texas border in February 2005.

Although they were convicted on 11 counts, the crime carrying the lengthiest penalty was for the "discharge of a firearm in relation to a crime of violence," a violation of section 924(c)(1)(a) of the U.S. Code. It carries a minimum 10-year prison sentence.

Cybercast News Service obtained a copy of an amicus curiae ("friend of the court") legal brief filed by Reps. Walter Jones (R-N.C.), Virgil Goode (R-Va.), and Ted Poe (R-Texas) in the former agents' appeal before the Fifth Circuit Court in New Orleans.

They accuse the prosecution of "creating a purported criminal offense never enacted into law by Congress," and of charging Ramos and Compean with a "non-existent crime."

Simply discharging a firearm near a violent crime is not illegal, the brief argued, saying the law they were convicted under is not a law at all, but a sentencing factor used to help a jury determine jail time after a conviction.

The brief cited several cases as precedent, including United States v. Barton in which the Fifth Circuit Court ruled that "discharging a firearm during and in relation to a crime of violence" could be used only as a sentencing factor, not as an element of a conviction. In Harris v. United States, the Supreme Court made a similar ruling.

The brief argued that, for a 10-year sentence, a defendant must be convicted under the specific terms laid out in section 924(c)(1)(a) (see section).

This provision is applicable, the section says, to "any person who, during and in relation to any crime of violence or drug trafficking crime ... uses or carries a firearm, or who, in furtherance of any such crime, possesses a firearm ..." If, and only if, these conditions apply can a defendant be sentenced to ten years in prison for the "discharge" of a firearm.

The brief argued that the shooting of drug smuggler Osvaldo Aldrete-Davila was not "in relation to" the drug crime because Ramos and Compean were themselves not participants in the drug crime.

Furthermore, Border Patrol Agents are authorized to carry and use firearms as law enforcement officers.

"By narrowing the issue to the discharge of the firearm," the brief said, "the prosecution and the trial court actions adversely affected the fairness of the entire trial, depriving defendants of any opportunity to present to the jury that they were using and carrying their firearms during and in relation to their employment as Border Agents."

The brief also criticized the prosecution.

"The criminal code cannot be treated by the prosecution as a legal chameleon, changing elements to fit the circumstances of the case that the government, in its discretion, wants to present to the judge and jury," it said.

One of the brief's authors, Larry Pratt of Gun Owners for America, told Cybercast News Service that this case could set an alarming precedent under which any law enforcement officer who fired a gun at the scene of a drug crime could be prosecuted under Section 924(c).

He also criticized U.S. Attorney Johnny Sutton, the lead prosecutor in the case.

"What [Sutton] was apparently trying to do is avoid the little detail that there was no underlying crime of carrying a gun because [Ramos and Compean] were authorized to carry guns," Pratt said. "So I think he tried to slide around and use the sentencing provision as an underlying crime."

'Perverse'

Rep. Jones conceded in a statement that Ramos and Compean may have been guilty of violating Border Patrol policy by shooting Aldrete-Davila and failing to file a subsequent report.

But Jones also blasted Sutton, saying the prosecutor "had no business charging [Ramos and Compean] with a crime that Congress clearly designed to apply only to the individuals who are possessing, using, or carrying firearms for the purpose of facilitating the commission of a crime - not to federal law enforcement agents."

"How perverse it is that this statute is now being used against law enforcement officers who were trying to stop drug trafficking," he added.

Sutton told the Senate Judiciary Committee on July 17 that it was his trial team that made the decision to bring the "discharge of a firearm in relation to a crime of violence" charge, and that he was not consulted on the issue.

"We have a deliberative process that goes on inside our office that I cannot describe," he said.

Sutton could not be reached for comment, and his spokeswoman said she did not think anyone else in the office would comment on the brief until it responds to the appeal in early August.

Asked about the appeal, Pratt said he was worried that it may be denied because the cited evidence had not been presented previously.

"The thing that concerns me most is that, because [the alleged misuse of Section 924(c)] wasn't brought up at the first trial, the Fifth Circuit Court could play legal games and say, well, too bad," he said.

Still, Pratt described himself as "hopeful" and warned that Sutton's tactics would eventually catch up with him.

"[Sutton] can only hide in the tall grass for so long and, Lord willing, the lawnmower's on the way in," he said.

BAGHDAD, June 24 — As the judge pronounced five death sentences on the man Iraqis know as Chemical Ali, the defendant seemed on Sunday to be a shadow of the merciless enforcer who oversaw poison gas attacks that killed thousands of Kurdish villagers in Iraq’s northern uplands nearly 20 years ago.

At the age of 61, severely weakened by diabetes, the defendant, Ali Hassan al-Majid, leaned heavily on a walking stick for the 18 minutes it took the judge to read guilty verdicts on counts of genocide, war crimes and crimes against humanity. Unlike his cousin Saddam Hussein, whose shouted defiance nearly drowned out the judge who sent him to the gallows last year, Mr. Majid offered no protest until the judge ordered bailiffs to lead him from the iron-ribbed cage that serves as a dock.

“Thanks be to God, now I’m leaving,” he said gruffly, as he turned to limp from the courtroom in the old Baath Party headquarters, a place where his reputation as a man who relished handing out summary sentences to Kurds, Shiites and other supposed enemies of the old government — and overseeing the executions himself, with a ghoulish pleasure evident in official videos — made him almost as feared as Mr. Hussein.

The Kurds, who make up 20 percent of Iraq’s population, have long sought justice for the Anfal, or Spoils of War, campaign that scarred their mountainous region.

Chemical Ali and company claimed they were merely attacking Kurdish guerrillas who had sided with Iran in the last stage of the 1980-88 Iraq-Iran war. Historians say Saddam wanted to make an example of the rebellious Kurds to show what happened to those who defied his authority.

Majid - Saddam’s main enforcer whom he used to crush dissent - declared thousand of villages “prohibited areas.”

The villages were bombed and razed, and tens of thousands of villagers - including women and children - were slain.

Majid used mustard gas and nerve agents to do the killing, thus earning his grim nickname.

At his trial, Majid, now in his mid-60s, admitted telling troops to execute Kurds who ignored orders to leave their villages but denied using poison gas.
