Obamination: Civilian Trials for Terrorists

When President Obama signed the "Ike Skelton National Defense Authorization Act for Fiscal Year 2011.", he made a statement which merits critical analysis.   Two crucial quotes from that statement  are reproduced below, with my  commentary.

 Section 1032 bars the use of funds authorized to be appropriated by this Act for fiscal year 2011 to transfer Guantanamo detainees into the United States,[...] Section 1032 represents a dangerous and unprecedented challenge to critical executive branch authority to determine when and where to prosecute Guantanamo detainees, based on the facts and the circumstances of each case and our national security interests.  The prosecution of terrorists in Federal court is a powerful tool in our efforts to protect the Nation and must be among the options available to us.  Any attempt to deprive the executive branch of that tool undermines our Nation's counterterrorism efforts and has the potential to harm our national security.

    President Obama complains that republicans defunded transfer of unlawful enemy combatants to the mainland for trial in civilian courts. He asserts that authority to decide where and how to prosecute those detainees is critical. 

    The President and Attorney General decided to try Khalid Sheikh  Mohammad in a civilian federal court in New York City.  The resulting uproar over issues of security, expense and psychological trauma to the survivors compelled  reconsideration of that idiotic and treasonous decision, which was delayed until after the general election for partisan political considerations. 

    The rights and privileges of citizens apply to citizens, they do not apply to unlawful enemy combatants who plotted attacks in the safety of sanctuaries provided by states with regimes inimical to the U.S.   The presumption of innocence, right to counsel, swift trial, confrontation of witnesses and discovery are intended to maximize individual liberty.  They are the best means we have of preventing the protector from morphing into a predator. 

    K.S.M. and his co-defendants are not charged with jay walking, petty theft or consumer fraud.  They plotted an act of war designed to maximize civilian casualties, inflict extreme economic damage and strike the first blow in a war to destroy this nation.  They authored and signed a confession of their guilt in which they revealed why they acted as they did and took pride in the act. Their confession was submitted to a military tribunal and is part of the record.  I have extracted the quote below from the opening paragraphs of that document of damnation, adding emphasis to make the obvious stand out so that even LibTards can perceive it.

    How in Hell can any American citizen know this without cursing and disrespectfully  demanding the immediate death & damnation of the signatories to that document?  The citizen who can refrain must be deemed a traitor to the nation and to the human race. 

    Trial in federal court?  Trial in a military tribunal?  Hell No!!! Tie them and dump them from a helicopter into the holding tank of a hog farm.  As for those who want to try them, tar, feathers and a ride out of the country on a rail.

With respect to section 1033, the restrictions on the transfer of detainees to the custody or effective control of foreign countries interfere with the authority of the executive branch to make important and consequential foreign policy and national security determinations regarding whether and under what circumstances such transfers should occur in the context of an ongoing armed conflict.  We must have the ability to act swiftly and to have broad flexibility in conducting our negotiations with foreign countries.

    The President just declared catch & release to be a vital national interest.  What receiving nation has a program to incarcerate or execute those unlawful combatants?  Which of them will not release the miscreants to return to the battlefield? 

    The President and Attorney General must be impeached and removed from office for treason.

That post did not bear out its promise; I found nothing but boiler plate about economic development & education projects.  The following quotes were mined from an AP story carried by AOL News.

The relationship between Islam and the United States is predator : prey and can never be anything else.  Muslims are under a "religious obligation"

When caliph Umar sent the Muslim army to Persia, a similar question was asked and answer returned. This quote comes from Sahih Bukhari 4.53.386.

No lying demagogue is ever going to tell you about that.  They seek to conceal, not to reveal the fatal facts of Islam.   Examine Rodwell's translation of 9:29 and compare it to Reliance of the Traveller, o9.8.

You have seen Allah's command to fight "people of the book" and the resulting Islamic law. What part of that is not clear to you?  What part of it requires explanation?  What part of it is subject to distortion, twisting, perversion or misinterpretation?  What did Allah command Muslims to do? What does the caliph do and why?  What did the Barbary Pirates do and why?  What does al-Qaeda do and why?  What is the difference between al-Qaeda and Islam?

    `Obama never fails to outrage me when he blathers about Israel.  The outcome he describes is an absolute impossibility, always was and always will be.  Israel can only obtain peace by ushering her enemies into Hell.  There is no alternative to total, absolute victory.  While there are Muslims, there is no peace.

    Politicians can not acknowledge objective factual reality because they view the existential necessity of eliminating Islam with the same revulsion engendered by the Holocaust.  They can not comprehend the fact that, while the Jews were innocent, Islam is perpetual war; genocidal conquest.  If vampires were real instead of mythological, they would be Muslims.  Muslims are people who have been conquered and co-opted to conquer others.  Politicians can not comprehend that fatal fact. 

    Politicians will not tap the wide and deep river of knowledge which flows through Islam's canon of scripture, tradition, exegesis & jurisprudence.  They will not read Allah's demonic conquest imperatives contained in Surahs Al-Anfal & At-Taubah.  Those are 8:39 & 9:29.  They will not read Sahih Bukhari 1.8.387 which confirms those imperatives.  They will not read 13:41 to learn how Allah gradually gives the land to Muslims in conquests, irreversibly. They will not read 2:191 to learn that Muslims must drive out those who drove them out.  They will not read 7:167 to learn that Allah will continually send someone to torment the Jews. Neither will they read Ibn Kathir's tafsir of that verse to learn that Jesus will return to lead the Muslims in the final genocide.

    Politicians will not read Sunan Abu Dawud  14.2477  to learn that Allah, on Moe's account, took a "special interest" in the "people of Syria". Neither will they read Sahih  Muslim Book 041, Number 6985 to learn that the Muslims can  not obtain Paradise without first completing the genocide of the Jews.

    Allah promised the Muslims victory. They conquered the Levant, later Jews recovered a tiny fragment of their ancient patrimony, in contravention of Allah's promise in 13:41. Muslims will never tolerate that. They must obey 2:191. They must complete the genocide. They have no alternative if they wish to obtain Paradise and avoid the fire.  Politicians can't comprehend this; if they could, they would never acknowledge it.   They must pretend that peace is possible. It ain't; unless Islam is eliminated.

President Obama will not recognize the fact that Islam is at war against us and reciprocate.  Al-Qaeda is Islam; Islam is al-Qaeda; it is a branch of the Muslim Brotherhood. The Qur'an is their constitution. Allah is their goal. Shahid is their highest aspiration.  Barack Hussein Obama and the traitors who proceeded him in office refuse to acknowledge objective factual reality.  They misidentify and misrepresent the enemy.

    Obama is a liar. Islam has not been hijacked, perverted, distorted or twisted. It is what it is: a war cult created for Moe's personal emolument through the profession of piracy & plunder. If you harbor doubts, read 8:1, 8:41 & 8:67. Who gets the spoils?  What was Moe's motivation?  Moe, speaking for Allah, commanded Muslims to fight pagans until only Allah is worshiped.  He commanded them to fight "people of the book" until they are subjugated and make annual extortion payments.  Moe said that our blood and property are not sacred to Muslims until we submit.

    What does the caliph do?  Reliance of the Traveller, Book o, Chapter 9 tells us. o9.8 says he makes war upon Jews & Christians until they are subjugated and pay extortion.  O9.9 says that he fights all other peoples until they become Muslim.  Rational and honest persons can connect the data points and draw logical conclusions. Politicians will not.

Two weeks ago, Ricks reported on a new publication by Army War College research professor Sherifa Zuhur on Hamas and Israel that informs readers that Hamas has been misunderstood due to the misreporting by “Israeli and Western sources that villainize the group.” Zuhur concludes that Hamas isn’t so bad after all, so we all just need to get along and embrace the terrorist group through negotiations — a view apparently endorsed by the Army War College when it published her defense of Hamas.

A second post last week, “Fiasco at the Army War College: The Sequel,” records an exchange between Ricks and defense expert and author Mark Perry. Assessing the academic state of affairs at the War College, Perry informed Ricks:

It’s worse than you think. They have curtailed the curriculum so that their students are not exposed to radical Islam. Akin to denying students access to Marx during the Cold War.

Idiotic treason! Why do we have Muslims deciding the curriculum at our war college? Why are our future military officers being shielded from knowledge of Islam's doctrines & practices? This nation is being run to ruin by analencephalopaths who should be removed from office or hung for treason.

I stand by those and spit in the face of PC. In addition, I have yet another post written today entitled, PC Strikes: Wrong On Czarbie.

The inspiration(s) which urged my writings are what I already know about Czarbie and his Marxist nonsense. Many other blog posts, pieces and articles around the internet that Gore made (and that Nancy confirmed) also have helped shape my conclusions - not that I really needed any, naturally.

If there is one error in the original NY Post piece, it is that the conversation was over a phone and not when Ambassador Crocker was in the room. From an article written 16 JUNE 2008:

[...] He said he told Zebari that negotiations for a Status of Forces agreement or strategic framework agreement between the two countries should be done in the open and with Congress's authorization and that it was important that that there be strong bipartisan support for any agreement so that it can be sustained through a future administration. He argued it would make sense to hold off on such negotiations until the next administration. [...]

Can you say or spell "Logan Act"? There are several more "foreign policy" making statements in that article that Czarbie himself said that he said to Hoshyar Zebari. Is it my fault that I pay attention to details and others do not? Not good enough? Then do your own research.

It makes no difference to me that no one in "the meeting" spoke up. Czarbie himself has admitted that he has discussed Foreign Policy with foreign leaders. If you have clicked the link above which takes you to the MSNBC piece, you would have seen it for yourself. If you have not seen it for yourself, it isn't my fault if you continue on thinking that Czarbie did nothing wrong.

Czarbie violated the Logan Act much like Nancy Pelosi has done on any number of occasions.

That's just the way it is. Get over it and demand that he answer for his "indiscretions".

Barack Hussein Obama. No matter what you call the floppy-eared goofy-ass socialist thug, raised by communists, socialists and social engineering Enemies of The State, he is indeed a Clear and Present Danger and should be shed and shunned from the borders of the United States. However, since he is - theoretically - an American citizen, that just isn't feasible. He has the constitutional right to be a blithering idiot if he so chooses to be. I don't understand why no one is holding Sen. Obama accountable.

My brother has been in Iraq for 17 months. 17 months he hasn't seen his 2 little girls, his wife, or any of the rest of us (his family). And no one cares that Sen Obama decided to use my brother and others like him in Iraq for some kind of political game.

No one gives a damn.

I don't understand how supporters of Sen Obama who have family or friends in the military are choosing to brush this off.

What isn't there to understand? I am not trying to sound crass or rude either when I ask that question. It has been readily evident to me for years now that the Libocrats want America to lose the war and the more Troops we lose, the better their chances are to win an election and lose a war...just for political power.

However, we have stopped them from doing that...lose the war. However, again, they are complicit and directly responsible for the at least 60% of the casualties among the Troops in Iraq and Afghanistan and I am working on proving that.

I shall never give that up and I am not ready to give up the fight.

The Obama Camp Confirms Treason and Logan Act Violations

In a previous post entitled, I'll Take "What Is Treason" For The Presidency Alex, located here, I brought to your attention Czarbie's duplicity and complicity in undermining a sitting United States President, General David Petraeus and our Troops. This is just one more incident and example in a long list of treasonous activity perpetrated by Democrat Party Leadership in their quest for dominance, power and control - at any cost. Yet, this isn't the end of the story.

In another post entitled, Democrats Want Economy To Tank, located here, I brought to your attention another example of the hideous and double standard ways and means of the Leftinistra within our own government. Again, this isn't the end of the story.

As more and more data becomes exposed and more prominent writers than I begin revealing the treasonous and treacherous activities of one Barack Hussein Insane Obama, we begin to see the inner workings of Czarbie's handlers, mainly George Soros.

Roger Guy at Radarsite brings us a list - a growing list - of fellow Enemies of The State and their consortium of those that would subvert America's founding. That piece is entitled, Obama's Endorsements From Our Enemies. IBD Editorials brings us Obama's Double-Dealing Diplomacy that will create an atmosphere of more harm to our Troops all in the name of political gain. As I and many others have so stated, this should be the Scandal of the Century as WUA so stipulates but we will not hold our breathe on that one, shall we? From IBD:

Yes. Country First, Czarbie. Czarbie says that he also puts country first but no one really knows what he means or which one.

At this point, it is not yet clear what official American negotiations Senator Obama tried to undermine with Iraqi leaders, but the possibility of such actions is unprecedented. It should be concerning to all that he reportedly urged that the democratically-elected Iraqi government listen to him rather than the US administration in power. If news reports are accurate, this is an egregious act of political interference by a presidential candidate seeking political advantage overseas. Senator Obama needs to reveal what he said to Iraq's Foreign Minister during their closed door meeting. The charge that he sought to delay the withdrawal of Americans from Iraq raises serious questions about Senator Obama's judgment and it demands an explanation.

Exactly so. When will the investigations begin? When will a Special Prosecutor be appointed? When will the Logan Act finally be enforced? Not only does Czarbie need to "explain" what he said, he needs to pony up to the bar, be a man and admit his blatant Logan Act violation and remove himself from any and all political office holding anywhere within the United States and her territories and possessions. Period. Perhaps he would be more at home in a socialist environment in which he feels is the best for mankind.

We already know and have seen and witnessed the Czarbie Camp admit to the Logan Act violation in the process of trying to refute the allegations. Hot Air has a blurb on this but the story keeps growing and growing. Let's take a look shall we?

In my original piece, I placed a quote from the New York Post as follows:

WHILE campaigning in public for a speedy withdrawal of US troops from Iraq, Sen. Barack Obama has tried in private to persuade Iraqi leaders to delay an agreement on a draw-down of the American military presence.

According to Iraqi Foreign Minister Hoshyar Zebari, Obama made his demand for delay a key theme of his discussions with Iraqi leaders in Baghdad in July.

"He asked why we were not prepared to delay an agreement until after the US elections and the formation of a new administration in Washington," Zebari said in an interview.

Obama insisted that Congress should be involved in negotiations on the status of US troops - and that it was in the interests of both sides not to have an agreement negotiated by the Bush administration in its "state of weakness and political confusion." [...]

Next we have the failed rebuttal which is actually a confirmation that Czarbie did in fact have these "chats" on his world tour of Look At Me I Am The One.

In fact, Obama had told the Iraqis that they should not rush through a “Strategic Framework Agreement” governing the future of US forces until after President George W. Bush leaves office, she said. [...]

I see no difference between the two quotes whatsoever. None. No daylight between them. They are composed with different verbiage but the intent and message is the same. I will provide a Snooper paraphrase for you and, yes, you can quote me if you so desire:

I am The One and I will be The One that you will have to deal with in February and I need, no, I demand that you ignore that cracker Bush guy and listen up. Leave these idiot jerks with guns in your country until I get into office so that I can claim the victory and bring the Troops home. You guys REALLY screwed up by getting all of these benchmarks accomplished and it really pisses me off. So, do not agree to anything the current President has to say about anything. OK? Are we clear?"

And that about sums it all up right there as far as I am concerned. Newsbusters asks a really silly question but, to be fair, it has to be asked: Why Is Media Ignoring Accusations Obama Interfered With Iraq Withdrawal Negotiations? You can read that one right here. It really is a silly question though, isn't it? We already know the answer as we are thinking about asking it, don't we? Don't we? The piece ends thusly:

The Obama campaign spent more than five hours on Monday attempting to figure out the best refutation of the explosive New York Post report that quoted Iraqi Foreign Minister Hoshyar Zebari as saying that Barack Obama during his July visit to Baghdad demanded that Iraq not negotiate with the Bush Administration on the withdrawal of American troops. Instead, he asked that they delay such negotiations until after the presidential handover at the end of January.

The three problems, according to campaign sources: The report was true, there were at least three other people in the room with Obama and Zebari to confirm the conversation, and there was concern that there were enough aggressive reporters based in Baghdad with the sources to confirm the conversation that to deny the comments would create a bigger problem.

What is Sedition? The Webster's Ninth New Collegiate Dictionary says; incitement of resistance to or insurrection against lawful authority. Seditious; disposed to arouse or take part in or guilty of sedition.

The Sedition Act of 1918 is as follows: (partial)

SECTION 3. Whoever, when the United States is at war, shall willfully make or convey false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States, or to promote the success of its enemies, or shall willfully make or convey false reports, or false statements,...or incite insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or shall willfully obstruct...the recruiting or enlistment service of the United States, or...shall willfully utter, print, write, or publish any disloyal, profane, scurrilous, or abusive language about the form of government of the United States, or the Constitution of the United States, or the military or naval forces of the United States...or shall willfully display the flag of any foreign enemy, or shall willfully...urge, incite, or advocate any curtailment of production...or advocate, teach, defend, or suggest the doing of any of the acts or things in this section enumerated and whoever shall by word or act support or favor the cause of any country with which the United States is at war or by word or act oppose the cause of the United States therein, shall be punished by a fine of not more than $10,000 or imprisonment for not more than twenty years, or both...[...]

Unfortunately, it was repealed in 1921. This is why the Sedition Act is not enforced. But, let not your hearts be troubled. Just because the Sedition Act was repealed in 1921, doesn't get the cowards in DC a Get Out Of Jail Free Card. {side bar...good read here} (Smith Act)

Section 2388. Activities affecting armed forces during war

(a) Whoever, when the United States is at war, willfully makes or conveys false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States or to promote the success of its enemies; or Whoever, when the United States is at war, willfully causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or willfully obstructs the recruiting or enlistment service of the United States, to the injury of the service or the United States, or attempts to do so - Shall be fined under this title or imprisoned not more than twenty years, or both.

(b) If two or more persons conspire to violate subsection (a) of this section and one or more such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be punished as provided in said subsection (a).

(c) Whoever harbors or conceals any person who he knows, or has reasonable grounds to believe or suspect, has committed, or is about to commit, an offense under this section, shall be fined under this title or imprisoned not more than ten years, or both.

So, even though the Sedition Act was repealed, there are still laws on the books with much the same language.

Tomorrow--as General David Petraeus provides his Iraq assessment to Congress--the antiwar group MoveOn.org is running a full-page advertisement in the New York Times under the headline: "General Petraeus or General Betray us? Cooking the books for the White House."

Let's be clear: MoveOn.org is suggesting that General Petraeus has 'betrayed' his country. This is disgusting. To attack as a traitor an American general commanding forces in war because his 'on the ground' experience does not align with MoveOn.org's political objectives is utterly shameful. It shows contempt for America's military leadership, as well as for the troops who have confidence in him, as our fellow soldiers in Iraq certainly do.

General Petraeus has served this country for over 35 years with honor, distinction, and integrity. And this is not just about General Petraeus. After all, if General Petraeus is "cooking the books," then the entire military chain of command in Baghdad, and all the staff, military and civilian, who have been working with General Petraeus are complicit, since Petraeus did not write his report in isolation. They are all, apparently, 'betray[ing] us.'

MoveOn.org has been working closely with the Democratic congressional leadership --as an article in today's Sunday New York Times Magazine makes clear. And consider this comment by a Democratic senator from Friday's Politico: "'No one wants to call [Petraeus] a liar on national TV,' noted one Democratic senator, who spoke on the condition on anonymity. 'The expectation is that the outside groups will do this for us.'

So, veterans who served in Iraq ask the Democratic leaders in Congress: Does MoveOn.org speak for you? Do you agree with MoveOn.org? Or do you repudiate this despicable charge?

I was wondering if the donation I sent in to the Senate Finance Committee ever got that Rubber Room for ReidCo installed.

ReidCo, in his infinite infidelities to this country - our Troops - We The People - Patriotism - The Flag - Truth - and any number of other national treasures he himself has shat upon, is still in denial and that is not "fonetics" for the river in Egypt.

I was waiting to write about this...this...poor excuse of a man until a few things were cleared up in my head. Namely, I was waiting for a former comrade to firm up some things and as Dean pointed out, ReidCo and his Merry Band of Losers in Nevada could not muster up more than MAYBE 50 unamerican moosetwits to counter the Fight For Victory Tour. My "confirmation" came from an individual that cannot and will not be named. Round One goes to Move America Forward.

That being said, like I needed confirmation, ReidCo has violated several laws of the land. Harry Reid is the Ring Leader and IAW the Constitution of the United States, should be removed from office by law enforcement officials but, there are no men left in DC. They have been polluted by PC.

What has ReidCo violated? Unlike the Moonbat Fruit Loop Brigades which claim that "BushCo" has violated the Constitution of the United States and NEVER offering up what exactly the infraction was according to the Constitution, it is clear that which ReidCo has not only broken but fractured. And, here it is.

The war in Iraq "is lost" and a US troop surge is failing to bring peace to the country, the leader of the Democratic majority in the US Congress, Harry Reid, said Thursday.

"I believe ... that this war is lost, and this surge is not accomplishing anything, as is shown by the extreme violence in Iraq this week," Reid said, on the same day US President George W. Bush was giving a speech at an Ohio town hall meeting defending the war on terror.

The right to impeach public officials is secured by the U.S. Constitution in Article I, Sections 2 and 3, which discuss the procedure, and in Article II, Section 4, which indicates the grounds for impeachment: "the President, Vice President, and all civil officers of the United States shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors."

Possibly, a better form of impeachment might be giving soldier's families, relatives of Iraqi's killed by the terrorists, and those trying to ensure Iraq's future 30 minutes in a locked room with Senator Harry Reid. Alone. No press. Leaving only a video to show to Nancy Pelosi, Schumer, et al.

The strategic gains against insurgents would lead to a changed and possibly longer-term role for Australian troops, shifting from security operations to a focus on training Iraqi soldiers and police.

General Petraeus told The Australian during a face-to-face interview at his Baghdad headquarters there had been a 75 per cent reduction in religious and ethnic killings in the capital between December last year and this month, a doubling in the seizure of insurgents' weapons caches between January and August, a rise in the number of al-Qa'ida "kills and captures" and a fall in the number of coalition deaths from roadside bombings.

"We say we have achieved progress, and we are obviously going to do everything we can to build on that progress and we believe al-Qa'ida is off balance at the very least," he said.

Now, the historically most international embarrassing CONgress in our nation's history is back in session after a "much needed recess", ReidCo is desperately trying to go back in time as if the successes in Iraq have not taken place and wants to change direction. I wish he would make up his mind. Before there was pretty much a stalemate in Iraq and he wanted to change direction. Most of America wanted a victory but he wanted to cut and run. Now that we are winning, he wants to cut and run again. Somebody really needs to get Reid that Rubber Room. No matter what is going on in Iraq, this pathetic excuse for a man wants to cut and run, take his ball and go home. Maybe he should have stayed on recess and gotten that warm pint of milk with those graham crackers and curled up with his blanky and taken a nap for a few hundred years.

Listen to the whining...my own three sons NEVER got away with whining like this...EVER! To this day, the only time whining is tolerated is if a viable solution is offered. No solution? No whining. PERIOD. I guess Reid's parents failed him.

Democrats also today convene the first of a series of hearings on Iraq policy as they await multiple reports on conditions in Iraq and prepare to challenge the president, who sought to preempt Democratic criticism with his surprise visit to Iraq Monday. Hearings are set for every day in either the House and Senate through the middle of next week.

Democratic leaders, who before the break had resisted most efforts on striking a compromise with Republicans on Iraq policy, have shown some new willingness to try to get together on legislation that could clear Congress. But they do not appear ready to completely abandon their push for a withdrawal.

“Many of my Republican colleagues wanted to hold off until September before joining the fight to change course in Iraq,” said Senator Harry Reid of Nevada, the majority leader. “Now that time has come and every objective assessment of the president’s strategy has shown that it has failed to deliver the political solution it promised. I am willing and ready to help my Republican colleagues keep their word by working in a bipartisan way to change course in Iraq.”

No matter what it is, there needs to be a change in direction. HEY! REID! The campaign trail ended MONTHS ago, moron!

With the recent trip to Iraq by GWB, it has been stated that if things keep going like they are going, we just might be able to have a troop coming home party. ReidCo ignores that and continues to lust after that Rubber Room.

What bothers me the most about ReidCo is the inherent and inbred ignorance they exhume and no matter the good news, it isn't what they want. They ran on a platform knowing damn well they were lying through their teeth. Even the reforms (political) that are taking place after a one-year stretch in time, ReidCo thinks that the Microwave Mentality should extend automatically because ReidCo thinks so.

It is time to burn up the fax machines, the email servers and the snail mail trails once again.
